Mikdash & Mishkan - Vayikra 5771


There are 2 thoughts that are very special to the whole Sefer Vayikra and an important connection to Sefer Shemos. A logical place to begin is with the Ramban’s Hakdama to Sefer Vayikra. The Ramban who explained that Sefer Shmos is the book of Galus and Geula and that it ends with the Shechina residing on the Mishkan, which is of course the zenith, the high point of Geulah, explains a continuation here as follows.  
The Ramban writes that Hashem commanded us to bring Korbanos in the Bais Hamikdash for the following reasons. The Korbanos are an opportunity for forgiveness and that Aveiros should not cause the Shechina which resides among Klal Yisrael as we have learned at the end of Sefer Shemos, to leave G-d forbid. The Korbanos are an opportunity to make sure that the Shechina remains in the Mishkan among Klal Yisrael. The Ramban explains this as the reason for the Korbanos.
There are a number of difficulties with the very idea that the purpose of the Korbanos are so limited to just keeping the Shechina in the Bais Hamikdash or in the Mishkan. First of all a Korban is called Raiach Nichoach even before the Bais Hamikdash or the Mishkan were built. We already find it being a Raiach Nichoach by Sefer Beraishis in Parshas Noach when Noach brings Korbanos in 8:20 – 21 (כ  וַיִּבֶן נֹחַ מִזְבֵּחַ, לַירוָר; וַיִּקַּח מִכֹּל הַבְּהֵמָה הַטְּהֹרָה, וּמִכֹּל הָעוֹף הַטָּהוֹר, וַיַּעַל עֹלֹת, בַּמִּזְבֵּחַ כא  וַיָּרַח יְרוָר, אֶת-רֵיחַ הַנִּיחֹחַ, וַיֹּאמֶר יְרוָר אֶל-לִבּוֹ לֹא-אֹסִף לְקַלֵּל עוֹד אֶת-הָאֲדָמָה בַּעֲבוּר הָאָדָם, כִּי יֵצֶר לֵב הָאָדָם רַע מִנְּעֻרָיו; וְלֹא-אֹסִף עוֹד לְהַכּוֹת אֶת-כָּל-חַי, כַּאֲשֶׁר עָשִׂיתִי). There we see clearly that Korbanos come for better reasons. Not just to remove a Chisaron but actually to provide a Maylah and a benefit. This is a difficulty with the Ramban’s position that the reason is to keep the Shechina among Klal Yisrael.
Secondly there are numerous Gemaras that give reasons for the Korbanos. The Gemara in Maseches Rosh Hashono 16a (11 lines from the bottom) says (תניא א"ר יהודה משום ר"ע מפני מה אמרה תורה הביאו עומר בפסח מפני שהפסח זמן תבואה הוא אמר הקב"ה הביאו לפני עומר בפסח כדי שתתברך לכם תבואה שבשדות ומפני מה אמרה תורה הביאו שתי הלחם בעצרת מפני שעצרת זמן פירות האילן הוא אמר הקב"ה הביאו לפני שתי הלחם בעצרת כדי שיתברכו לכם פירות האילן ומפני מה אמרה תורה נסכו מים בחג אמר הקדוש ברוך הוא נסכו לפני מים בחג כדי שיתברכו לכם גשמי שנה). Bring before me the Shtei Halechem on Shavuos so that there should be a blessing  among the fruits of the year. The Korbanos bring Beracha and don’t simply prevent a Chisaron of the Shechina leaving. It actually brings specific Beracha. Certainly a Korban Todah which is a Korban of Thanksgiving is more than just a Kapparah for an Aveira. Therefore these are difficulties that we have with the idea, the concept of this Ramban.
I saw a beautiful answer brought in the name of the Shem MiShmuel in the Sefer Iyunim Bamikra (This Sefer had the Mar Makom).  The Shem MiShmuel in Shnas Taf Reish Ayin Vav says a beautiful Yesod from his father the Avnei Nezer. Really he explains something even more fundamental than the Korbanos. We find the name of the place of the Mizbaiach and the Aron in the Chumash as being called the Mishkan. Later when Shlomo Melech builds it, it is called the Bais Hamikdash. These names are used interchangeably. V’asu Li Mikdash refers to the Mishkan. So that we have two names Mishkan and Mikdash which are used interchangeably but primarily in the Midbar it is called the Mishkan and in Eretz Yisrael it is called the Mikdash.
The Avnei Nezer explains that each represents one function of the Mishkan, Mikdash. The word Mishkan means residing of the Shechina among Klal Yisrael. The name Mishkan represents a place where the Shechina resides. Where Korbanos are brought for forgiveness so that the Shechina should not leave. Since in the Midbar the Mishkan and the fact that the Shechina came upon the Mishkan was as the Ramban explains at the end of Sefer Shemos an Inyan of Kaparah for the Eigel, so the primary name in the 40 years in the Midbar is Mishkan. Something that began as a Kapparah for Klal Yisrael. Now of course the Mishkan is not only a place of Kapparah (of forgiveness). We have asked in our Kashas and demonstrated from those Mar Mekomos. It is also a Mikdash, a place that brings to higher and higher levels of Kedusha. Sheyiskadshu Bnei Yisrael. So there is a second aspect an aspect of reaching higher levels of Kedusha and deserving a Beracha of the Peiros and the Tevuos Hashana of a Raiach Nichoach. For that the name is Mikdash.  When Shlomo Hamelech built the Bais Hamikdash it was primarily for that and therefore the name Bais Hamikdash was used. However, there is a dual purpose in this area called either Mishkan or Mikdash. The Ramban’s introduction is explaining the flow of Shemos to Vayikra, explaining what took place in the Midbar, and therefore, his explanation is true for the Mishkan aspect of this place. The place to make sure that there is forgiveness and that the Shechina does not leave. That is not it, there is also the Mikdash aspect. When we understand these two aspects we can answer what appears to be a Stirah in the Rambam.
The Rambam in bringing a Posuk for this Mitzvah brings one Posuk in Hilchos Bais Habichira and one in Hilchos Melachim. That is, in Hilchos Bais Habichira Perek 1:1 the Rambam brings a Posuk V’asu Li Mikdash V’shachanti B’sochom. In the beginning of Hilchos Melachim there is a different Posuk brought, Lishicno Sidrishu U’vasa Shama. There are 2 different Pesukim, however, they are not a contradiction. There are dual aspects, V’asu Li Mikdash. Mikdash is an aspect of Bais Hamikdash and Lishicno Sidrishu. Lishichno is a Lashon of Mishkan and both aspects are true aspects. Therefore we have a Chiddush and a Yesod, there is a Mishkan and there is a Mikdash. The place of Kaparah, the place of reaching higher and higher level of Kedusha. The 2 aspects of Avodas Hashem, the 2 aspects of this special place where the Shechina resides.

Sun Pictures - Yisro 5772


There is one Issur D’oraissa that is Nogea today that is probably the least known and the most misunderstood of the Mitzvos D’oraissa and as a matter of fact it appears in the Aseres Hadibros which is something you would think everybody would know.
In the Aseres Hadibros we find the Issur of 20:3 (לֹא-תַעֲשֶׂה לְךָ פֶסֶל, וְכָל-תְּמוּנָה, אֲשֶׁר בַּשָּׁמַיִם מִמַּעַל, וַאֲשֶׁר בָּאָרֶץ מִתָּחַת--וַאֲשֶׁר בַּמַּיִם, מִתַּחַת לָאָרֶץ). There is an Issur D’oraissa to make an image of heavenly bodies that are in the heaven or earth. There, it is part of the Issur of Avodah Zora. However, right after the Aseres Hadibros, the Torah explains in 20:19 (לֹא תַעֲשׂוּן, אִתִּי: אֱלֹהֵי כֶסֶף וֵאלֹהֵי זָהָב, לֹא תַעֲשׂוּ לָכֶם). The Gemara in Maseches Rosh Hashono (the Gemara has a long Arichus on 24b regarding this) explains that this expands the Issur in the Aseres Hadibros. (לֹא תַעֲשׂוּן, אִתִּי), the Gemara says that the Lav of the Aseres Hadibros applies to making an image to be used as an Avodah Zora. (לֹא תַעֲשׂוּן, אִתִּי) comes to include even a heavenly image not used for Avoda Zora. As explained in Shulchan Aruch in Yore Dai’a 144, there is an Issur of drawing in a 2 dimensional image (not a statue) of the heavenly bodies of the sun, moon, and the stars.
This is an Issur D’oraissa that is Muttar as the Gemara says to do it for learning purposes but outside of learning purposes to make it as something which is painting a picture for beauty, there is an Issur D’oraissa. Unfortunately this is not well known and I don’t know on what newspapers like the Hamodia rely when their weather report has the pictures of the sun. Perhaps they rely on the fact that it is printed by non-Jews who are not prohibited from making these images but still the person in the office who sets the page would seem to have a prohibition. As I said, it is not a well-known Din but it is a Halacha in Shulchan Aruch and nobody argues. That drawing an image of the sun or the moon is an Issur D’oraissa.

בחיי אדם (היה מחותנו) הביא דברי הגר"א ולפעמים חלק עליו. ובנשמת אדם נמנע מלהזכירו כלל. בהקדמתו (בכמה דפוסים) הסביר שאחרי שיצא החיי אדם שמע דבת רבים שרננו על שחלק על הגר"א. וכת' שהגר"א ניחא לי' כשמפלפלים בדבריו וזה דרך ההלכה.

צריך להבין מה שהבטיחו לרחב להחיותה בלי לשאול יהושע והסנהדרין.
על איסור לא תחיה כל נשמה כבר דיברנו בזה בשיטת רש"י ותוס'. אבל יש אזהרה בפרשת מסעי שהנשארים יהיו "לשיכים בעיניכם" ופי' רמב"ן שאין הכוונה שיצערו אותנו גופנית אלא שמעשיהם ישפיעו עלינו.
מהרש"א יבמות סו. הק' למה לא שבר משה את הלוחות עד שראה העגל, הרי כבר ידע שעשוהות שהקב"ה הגיד לו. ותי' הגר"א במגילת אסתר ה יד לא תהא שמיעה גדולה מראייה. (ראש השנה). ותמה האגרות משה יו"ד א רכג ואו"ח ג נ, אם הקב"ה אמר לו אז ידע בבירור גמור. הסביר ר' הוטנר בפחד יצחק סוכות שכוונת הגר"א אינה לענין בירור, אלא שראייה פועלת בנפש הרואה יותר מידיעה.
וביאר בזה הפח"י הטעם שנתעטף הקב"ה והראה דוקא למשה סדר תפלה. ובפרשת מקץ "את אשר ה' עושה הראה את פרעה."

Hands - Beshalach 5772


(וְהָיָה, כַּאֲשֶׁר יָרִים מֹשֶׁה יָדוֹ--וְגָבַר יִשְׂרָאֵל; וְכַאֲשֶׁר יָנִיחַ יָדוֹ, וְגָבַר עֲמָלֵק). Moshe stretching his arms out heavenward caused Klal Yisrael to be able to win in battle. The Gemara in Maseches Rosh Hashanah 29a (16 lines from the top) says (מתני' והיה כאשר ירים משה ידו וגבר ישראל וגו' וכי ידיו של משה עושות מלחמה או שוברות מלחמה אלא לומר לך כל זמן שהיו ישראל מסתכלין כלפי מעלה ומשעבדין את לבם לאביהם שבשמים היו מתגברים ואם לאו היו נופלים) that that was related to Klal Yisrael looking heavenwards. What is the Remez of the stretching out of these hands by Gedolei Yisrael who Daven that way? They Daven as Shlomo Hamelech did by stretching out their arms to heaven. Here by Amaleik it is especially important. Because Rashi says that Amaleik came because Sherafu Yidaihem Min Hatorah. Rashi uses the same idea of the symbolism of hands. Rafu Yidaihem Min Hatorah, their hands were weakened in their torah study or Torah observance and therefore, Amaleik came. What is the symbol of this Remez of Yadaim?
I had once seen and I don’t remember the name of the Sefer someone who quoted in the name of the Chiddushai Harim in Parshas Re’ey not in regard to Amaleik but in regard to Bikkurim. Bikkurim is the gift brought to the Bais Hamikdash, one’s first fruits. The Posuk in Parshas Re’ey in 12:17 refers to it as (ותרומת ידך: אלו הבכורים) the gift of your hands. There too the question is why mention the hands? The Posuk in Devarim 26:4 says (וְלָקַח הַכֹּהֵן הַטֶּנֶא, מִיָּדֶךָ). When the Bikkurim are brought to the Bais Hamikdash the language is the Kohen takes the basket from your hand. Why mention the hand? Anything brought to the Bais Hamikdash is given with the hand.
The Chidushei Harim says the mention of the hand is to show that a person has to understand that whatever he does with his hands comes from Hashem and not from him. The opposite of the sense of Kochi V’otzem Yadi. The sense that a person’s own ability is what causes success. On the contrary, it comes from Hashem. The first fruits of a farmers work is brought to the Beis Hamikdash as Terumas Yedchem. As an expression of the fact that the fruit comes from the Ribbono Shel Olam. Once he stretches out his hands towards heaven in Davening he is saying symbolically that my hands, the work of my hands all comes from the Ribbono Shel Olam. My prayer is that my hands should be successful. In Tehillim we find in 134:2 (שְׂאוּ-יְדֵכֶם קֹדֶשׁ; וּבָרְכוּ, אֶת-יְ רוָר) S’u Yidaichem Kodesh Uvarchu Es Hashem. Dovid Hamelech says stretch your hands out in holiness when you bless Hashem. Show that your hands, whatever they do comes from the Ribbono Shel Olam.
We find that Rebbi (the Tanna) before his death stuck out his fingers towards heaven. That idea that the hand represents that, is an idea of stretching out your hands towards heaven and saying that the Koach of my hand comes from Hakadosh Baruch Hu.
Sheivet Levi had no portion in Eretz Yisrael. They understood that everything they received came from Hashem. When the Kohen accepts the basket from the Yisrael Rashi says that the basket of the Bikkurim is brought to the Beis Hamikdash (ולקח הכהן הטנא מידך: להניף אותו. כהן מניח ידו תחת יד הבעלים ומניף).The Yisrael (the farmer) would be holding his hands under the basket. The Kohen would put his hands under the hands of the Yisrael and lift it heavenward. What a beautiful expression, showing the Kohen’s hands which are hands that understand that there is no Kochi V’otzem Yadi that it all comes from Hashem. He lifts up the Yisrael’s hands with his towards heaven. That is the expression of lifting ones hands heavenward. (והיה כאשר ירים משה ידו וגבר ישראל). When Jews understand that everything depends on the blessing of heaven then (וגבר ישראל), Klal Yisrael has strength and Klal Yisrael is successful.

Two Dinim - Bo 5769


Rav Elchonon in the Koivetz Ma’amarim has a beautiful piece with far reaching implications. By Makas B’choirois in 12:27, the Pasuk says, (אֲשֶׁר פָּסַח עַל-בָּתֵּי בְנֵי-יִשְׂרָאֵל בְּמִצְרַיִם, בְּנָגְפּוֹ אֶת-מִצְרַיִם, וְאֶת-בָּתֵּינוּ הִצִּיל). That Hashem passed over the Bnei Yisrael’s houses when he killed the Mitzriyim. Rashi explains that Hashem did this himself without a shaliach, and the reason given is since if Hashem would give over this power to a Malach, the Malach would not differentiate between a Tzaddik and a Rasha.

This concept is extremely difficult, as we know the Malach Hamaves doesn’t kill without being given a specific name and address? In addition, making such a fuss over the fact that Hashem skipped over the houses of the Bnei Yisrael seems ridiculous, as every time people have to be killed other people are not killed. What is so special of jumping over a home? In addition, all the Makkos affected the Mitzrim and didn’t affect the Yidden, so why was this so special?

Rav Elchonon writes an important Yesoid, in which he brings down a Ran and a Rashba. Hakadoish Baruch Hu judges the world on 2 levels, a Din Haklali and Din Haprati. The Din on the Tzibbur which is judged separately than the individual is the Din Haklali, while in contrast, the Din on the individual is the Din Haprati. He writes a Klal that the Din of the Klal overrides the Din Haprati to the extent that there might be a contradiction between the two.

The Mishnah on Daf 16 of Maseches Rosh Hashonah says (בארבעה פרקים העולם נידון בפסח על התבואה בעצרת על פירות האילן בר"ה כל באי עולם עוברין לפניו כבני מרון שנאמר (תהילים לג) היוצר יחד לבם המבין אל כל מעשיהם ובחג נידונין על המים) that a person is judged on Rosh Hashonah and the Chasimah is on Yom Kippur. The Mishnah also says that on Sukkos a person is judged for rain, on Pesach for wheat, and Shavuous for fruit. The Ran asks, if on Rosh Hashonah we were already judged Mi Yai’oni Umi yai’osher, then how are we being judged again at other times during the year for rain, wheat, and fruit?

The Ran answers that on Rosh Hashonah, individuals are judged, however, on the Shalosh R’golim, the Tzibbur is judged on Mamonus (money matters). At the end of it all, the Din on the Tzibur overrides the Din on the Yachid. This says Rav Elchonon is what is meant by since Hashem gave Rishus to the Malach, the Malach doesn’t differentiate between the Tzadik and Rasha. If the Din on the Tzibbur of Mitzrayim is that all B’choirim must be killed, then since the Din on the Klali overrides the Din on the Prati, so normally Klal Yisrael would have been included in that Din. Hashem created Klal Yisrael as a new nation on Pesach night by separating us from the Mitzriyim by skipping over our houses. That is why we are making such a big fuss about it. Klal Yisrael was removed from the Din Haprati of Mitzrayim. The blood on the doorpost was like a flag for the new nation.

There is a T’shuva of the Rashba regarding Meshaneh Makoim Meshaneh Mazel. If a person is not having good Mazel, if it is because of the Din Haklali, then if he moves, it will help him. Of course, if it comes because of the Din Haprati, then it won’t help him.
